These Terms govern your access to, usage of all content, Product and Services available at https://www.greenoughharbourcommunity.ca website (the “Service”) operated by Greenough Harbour Community (“us”, “we”, or “our”).
Your access to our services are subject to your acceptance, without modification, of all of the terms and conditions contained herein and all other operating rules and policies published and that may be published from time to time by us.
Please read the Agreement carefully before accessing or using our Services. By accessing or using any part of our Services, you agree to be bound by these Terms. If you do not agree to any part of the terms of the Agreement, then you may not access or use our Services.
Intellectual Property
The Agreement does not transfer from Us to you any of Ours or third party intellectual property, and all right, title, and interest in and to such property will remain (as between the parties) solely with Greenough Harbour Community and its licensors.

In using the Services, you may use third-party services, products, software, embeds, or applications developed by a third party (“Third Party Services”).
If you use any Third Party Services, you understand that:
- Any use of a Third Party Service is at your own risk, and we shall not be responsible or liable to anyone for Third Party websites or Services.
- You acknowledge and agree that We shall not be responsible or liable for any damage or loss caused or alleged to be caused by or in connection with the use of any such content, goods or services available on or through any such web sites or services.
Accounts
Where use of any part of our Services requires an account, you agree to provide us with complete and accurate information when you register for an account.
You will be solely responsible and liable for any activity that occurs under your account. You are responsible for keeping your account information up-to-date and for keeping your password secure.
You are responsible for maintaining the security of your account that you use to access the Service. You shall not share or misuse your access credentials. You must notify us immediately of any unauthorized uses of your account or upon becoming aware of any other breach of security.
Termination
We may terminate or suspend your access to all or any part of our Services at any time, with or without cause, with or without notice, effective immediately.
If you wish to terminate the Agreement or your Greenough Harbour Community account, you may simply discontinue using our Services.
All provisions of the Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
Disclaimer
Our Services are provided “AS IS.” and “AS AVAILABLE” basis. Greenough Harbour Community and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Greenough Harbour Community, nor its suppliers and licensors, makes any warranty that our Services will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.
Jurisdiction and Applicable Law
Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of our Services will be governed by the laws of Canada.
The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be the state and federal courts located in Canada.
Changes
Greenough Harbour Community reserves the right, at our sole discretion, to modify or replace these Terms at any time.
If we make changes that are material, we will let you know by posting on our website, or by sending you an email or other communication before the changes take effect. The notice will designate a reasonable period of time after which the new terms will take effect.
If you disagree with our changes, then you should stop using our Services within the designated notice period, or once the changes become effective.
Your continued use of our Services will be subject to the new terms.
Privacy

Welcome to https://www.greenoughharbourcommunity.ca (the “Site”). We understand that privacy online is important to users of our Site. This statement governs our privacy policies with respect to those users of the Site (“Visitors”) who visit and make use of the various services offered by Greenough Harbour Community (collectively, “Services”).
“Personally Identifiable Information”
refers to any information that identifies or can be used to identify, contact, or locate the person to whom such information pertains, including, but not limited to, name, address, phone number, fax number, email address, financial profiles, social security number, and credit card information. Personally Identifiable Information does not include information that is collected anonymously (that is, without identification of the individual user) or demographic information not connected to an identified individual.
What Personally Identifiable Information is collected?
We may collect basic user profile information from all of our Visitors. We collect the following additional information from our lot owners and home owners – only for use of the lot owners and home owners (as stored in the Greenough Harbour Contacts List): the names, addresses, phone numbers and email addresses of lot owners and home owners.
What organizations are collecting the information?
No additional third party service vendors or organizations are collecting this information. This information is locked and restricted to registered home and lot owners.
How does the Site use Personally Identifiable Information?
We use Personally Identifiable Information to customize the Site, and to make appropriate service offerings. We may email Visitors and registered users about research or information related to the subject matter of the Site. We may also use Personally Identifiable Information to contact Visitors in response to specific inquiries, or to provide requested information.
With whom may the information may be shared?
Personally Identifiable Information about lot owners or home owners may be shared with other potential lot owners who wish to evaluate potential lot purchases. We may share aggregated information about our Visitors, including the demographics of our Visitors and home or lot owners with our affiliated agencies and third party vendors. We also offer the opportunity to “opt out” of receiving information or being contacted by us or by any agency acting on our behalf.
How is Personally Identifiable Information stored?
Personally Identifiable Information collected by Greenough Harbour Community is securely stored and is not accessible to third parties except for use as indicated above.
What choices are available to Visitors regarding collection, use and distribution of the information?
Visitors may opt out of receiving unsolicited information from or being contacted by us and/or our vendors and affiliated agencies by responding to emails as instructed, or by contacting us via EMAIL at info@greenoughharbourcommunity.ca.
Cookies
A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns.
Are Cookies Used on the Site?
Cookies are used for a variety of reasons. We use Cookies to obtain information about the preferences of our Visitors and the services they select. We also use Cookies for security purposes to protect our lot owners and home owners. For example, if a visitor is logged on and the site is unused for more than 10 minutes, we may automatically log the visitor. Visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using https://www.greenoughharbourcommunity.ca, with the drawback that certain features of website may not function properly without the aid of cookies.
How does Greenough Harbour Community use login information?
Greenough Harbour Community uses login information, including, but not limited to, IP addresses, ISPs, and browser types, to analyze trends, administer the Site, track a user’s movement and use, and gather broad demographic information.
What partners or service providers have access to Personally Identifiable Information from Visitors on the Site?
Greenough Harbour Community has entered into and will continue to enter into partnerships and other affiliations with a number of organizations such as The Bruce Peninsula Biosphere Association etc. Such organizations may have access to certain Personally Identifiable Information on a need to know the basis for evaluating visitors for service eligibility. Our privacy policy does not cover their collection or use of this information. Disclosure of Personally Identifiable Information to comply with the law. We will disclose Personally Identifiable Information in order to comply with a court order or subpoena or a request from a law enforcement agency to release information. We will also disclose Personally Identifiable Information when reasonably necessary to protect the safety of our Visitors.
How does the Site keep Personally Identifiable Information secure?
All of our board members are familiar with our security policy and practices. The Personally Identifiable Information of our Visitors is only accessible to a limited number of qualified board employees who are given a password in order to gain access to the information. We audit our security systems and processes on a regular basis. Sensitive information, such as credit card numbers or social insurance numbers, is not collected by this website. While we take commercially reasonable measures to maintain a secure site, electronic communications and databases are subject to errors, tampering, and break-ins, and we cannot guarantee or warrant that such events will not take place and we will not be liable to Visitors for any such occurrences.
How can Visitors correct any inaccuracies in Personally Identifiable Information?

Can a Visitor delete or deactivate Personally Identifiable Information collected by the Site?
We provide Visitors with a mechanism to delete/deactivate Personally Identifiable Information from the Site’s database by contacting info@greenoughharbourcommunity.ca. However, because of backups and records of deletions, it may be impossible to delete a Visitor’s entry without retaining some residual information. An individual who requests to have Personally Identifiable Information deactivated will have this information functionally deleted, and we will not sell, transfer, or use Personally Identifiable Information relating to that individual in any way moving forward.

What happens if the Privacy Policy Changes?
We will let our Visitors know about changes to our privacy policy by posting such changes on the Site. However, if we are changing our privacy policy in a manner that might cause disclosure of Personally Identifiable Information that a Visitor has previously requested not be disclosed, we will contact such Visitor to allow such Visitor to prevent such disclosure.
